There are a number of ways we can help you keep your property. First, we try negotiating with the lender. The goal is to obtain a modification or forebearance and have the foreclosure case dismissed. If this is unsuccessful, we can help you file for Chapter 13 bankruptcy which will put you on a 5-year plan to getting caught up.
If you can afford your property but just need to get caught up, then we recommend negotiating a solution with the lender or utilizing a Chapter 13 Bankruptcy. If these are unsuccessful or not desirable then selling the property is the best way to preserve your equity.
Sometimes we have to think outside of the box find creative ways to make the property generate income. Renting part of the property or having family or friends move in to defray costs can be successful options. If that's not possible or desirable then we will look to list the property for sale to get best price possible for the condition of the property.
The property will be advertised and sold at a public auction. You will receive notification of the sale date and have an opportunity to save the property right up until the "rights of the parties are fixed," i.e., 10-days after the sale or last upset bid. At that point the sale if finalized and a deed to the property is issued to the high bidder after full payment. If you have not vacated the property the new owner can have you removed by the local Sheriff's office. That is why "time is of the essence" when dealing with distressed real estate.
